2. Acceptance of These Terms

These Terms and Conditions govern your use of the Website and, where applicable, our training and educational services.

By using the Website, you agree to comply with these terms.

Where you book or purchase a course or service, additional course-specific conditions, booking terms or a separate written agreement may apply. These will be made available where relevant before you commit to the purchase or booking.

If these terms conflict with a separate written agreement, the separate agreement will take precedence in relation to the subject of that conflict, to the extent agreed and permitted by law.

3. Eligibility and Acceptable Use

Our services are intended for adults aged 18 or over, unless a particular service expressly provides otherwise.

You agree to use the Website lawfully and responsibly. You must not:

  • Use the Website for unlawful, fraudulent or misleading purposes.

  • Attempt to gain unauthorised access to our systems, accounts or information.

  • Upload viruses, malicious software or other harmful material.

  • Interfere with the security, availability or proper operation of the Website.

  • Misrepresent your identity or your authority to act on behalf of a business.

  • Copy, distribute or commercially exploit our content except as permitted by these terms, applicable law or our written permission.

If you create an account, you must provide accurate information, keep your login details secure and notify us promptly of suspected unauthorised access.

We may suspend or restrict access where reasonably necessary to address a security risk, unlawful activity or a material breach of these terms. Any action we take will be subject to applicable law and any contractual or statutory rights you have.

4. Our Training and Educational Services

We provide training and educational services that may include:

  • Online courses and learning materials.

  • In-person training and workshops.

  • Accredited qualifications and assessments.

  • Consultancy and bespoke corporate training.

  • Related educational resources and support.

The content, duration, delivery method, price, prerequisites, assessment arrangements and other relevant details of each service will be described on the relevant Website page, booking documentation, quotation or service agreement.

We will provide services with reasonable care and skill as required by law.

We may make reasonable changes to course content, instructors, schedules or delivery arrangements where necessary. If a material change affects a booked service, we will notify affected customers and explain the available options in accordance with the applicable agreement and legal requirements.

5. Bookings and Contract Formation

Bookings and purchases may be made through the Website or by another method we make available.

A contract will be formed when we accept your order or booking, as specified in the booking process, confirmation or applicable written agreement.

Before committing to a purchase, you should review the service description, total price, payment arrangements, delivery details and applicable cancellation conditions.

We may decline a booking where we have a legitimate reason, including course unavailability, a genuine pricing error or suspected fraudulent activity.

If we take payment for an order that we subsequently do not accept, we will arrange an appropriate refund.

We will provide confirmation of accepted bookings or purchases electronically or by another agreed method.

6. Prices and Payment

Prices will be displayed on the Website or provided in a quotation or other booking documentation.

Unless otherwise stated, prices are quoted in pounds sterling (£). Applicable VAT and other mandatory charges will be disclosed as required by law.

We may accept one-off payments for courses and services and invoice payments for business customers.

For corporate training and consultancy, the applicable quotation or written agreement may specify:

  • Fees and payment deadlines.

  • Deposits and staged payments.

  • The number of participants included.

  • Travel or other additional expenses, where applicable.

  • Cancellation, rescheduling and postponement arrangements.

  • Any additional commercial conditions.

Payment must be made in accordance with the applicable booking conditions or agreement.

Overdue payments may be pursued in accordance with the contract and applicable law. Any interest, recovery costs or late-payment charges must have an appropriate legal or contractual basis.

We will not impose undisclosed charges or apply payment terms that unlawfully restrict consumer rights.

7. Consumer Cancellation Rights

Where an individual purchases qualifying services or digital content online or through another distance-selling method, statutory cancellation rights may apply. These can include a 14-day cancellation period, subject to the applicable legislation and any relevant exceptions.

We will provide the information and cancellation instructions required by law before the consumer becomes bound by the relevant contract.

Services starting during the cancellation period

If you ask us to begin providing a service during a statutory cancellation period, we will obtain any express request required by law and provide the required information about potential charges if you cancel.

Where the law permits, you may be required to pay a proportionate amount for services supplied before cancellation.

Digital content

Where digital learning materials or other digital content are supplied immediately, any loss of a statutory cancellation right will only apply if all applicable legal requirements have been satisfied, including any required express consent and acknowledgement.

Exceptions

Certain contracts may be exempt from statutory cancellation rights or subject to different rules. Whether an exception applies will depend on the nature of the service and the circumstances of the contract. We will not assume that a course booking is exempt simply because it has a scheduled date.

Nothing in these terms removes any mandatory statutory rights or remedies.

The applicable cancellation procedure and any additional course-specific conditions will be provided before purchase.

8. Business Bookings, Cancellations and Rescheduling

For bookings made by businesses or organisations acting for business purposes, cancellation, rescheduling, postponement, deposits and refunds will be governed by the applicable quotation, booking conditions or written agreement.

Corporate customers should review those terms before confirming a booking, particularly where training is arranged for a group of employees or participants.

If we need to cancel or reschedule a course or training session, we will notify affected customers and explain the available arrangements. Depending on the circumstances and applicable agreement, these may include an alternative date, an alternative delivery arrangement or a refund.

Any cancellation charges or other remedies must be consistent with the relevant contract and applicable law.

9. Online Courses and Digital Learning Materials

Online courses and digital learning resources may be subject to access periods, usage restrictions and specific completion requirements. These will be explained in the relevant course description or booking documentation.

You must not share account credentials, distribute paid materials to unauthorised users, bypass access controls or reproduce restricted learning resources without permission, except where permitted by law.

We may temporarily restrict access for maintenance, security, non-payment or a material breach of these terms. Where appropriate, we will provide notice and an opportunity to resolve the issue.

We do not currently offer subscription services under these terms. If subscription services are introduced, additional terms will be provided where necessary.

10. Accredited Qualifications and Certificates

Where a course offers an accredited qualification, certificate or other formal recognition, the relevant course information will describe the qualification and the applicable awarding or accrediting arrangements.

Admission, attendance, assessment, completion, resits, appeals and certification may be subject to requirements imposed by the relevant awarding organisation, accrediting body or regulatory framework.

Participants are responsible for meeting the stated course requirements and providing accurate information where required.

We do not guarantee that participation in a course will result in a particular examination result, qualification, employment opportunity, promotion or professional outcome.

Any claims about accreditation, recognition or qualification status will be made accurately. Customers should check the relevant course information to establish precisely what qualification or certificate is offered and any conditions attached to it.

11. Intellectual Property and Course Materials

Unless otherwise stated, intellectual property rights in the Website and our course materials belong to The London Hospitality Training Company Ltd or our licensors.

This includes text, videos, presentations, workbooks, assessments, graphics, logos, branding, downloadable materials and other educational resources.

We grant authorised participants a limited, non-exclusive, non-transferable right to use purchased or supplied materials for their own learning or for internal business purposes expressly agreed with us.

Unless we give written permission or applicable law permits it, you must not:

  • Reproduce, publish, sell or commercially redistribute our materials.

  • Share paid resources with unauthorised individuals.

  • Record or distribute training sessions without permission.

  • Remove copyright notices or branding.

  • Present our materials as your own intellectual property.

Purchasing a course does not transfer ownership of our intellectual property.

For corporate bookings, the number of authorised participants and any additional rights to reuse or distribute materials will be governed by the applicable agreement.

12. Participant Conduct

Participants must behave respectfully towards trainers, other learners and staff.

Harassment, discrimination, threatening behaviour, deliberate disruption, impersonation and misuse of another participant's personal information are not acceptable.

We may take proportionate action in response to misconduct, including issuing a warning, removing a participant from a session or restricting access to learning resources.

Any effect on fees, continued participation or refunds will be determined by the applicable agreement and mandatory legal rights.

13. Educational Information and Professional Advice

Our educational materials are provided for the purposes described in the relevant course or service information.

Unless expressly agreed otherwise, general educational content does not constitute legal, financial, medical or other regulated professional advice.

We do not guarantee particular outcomes from participating in training or applying the information learned. You should obtain independent professional advice where appropriate.

Nothing in this section excludes our obligation to provide services with reasonable care and skill or any other obligation that cannot lawfully be excluded.

14. Privacy and Personal Information

We process personal information in accordance with applicable data protection law and our Privacy Policy.

Our Privacy Policy should explain what personal information we collect, why we collect it, how it is used and retained, who it may be shared with, and the rights available to individuals.

It should also explain how we handle relevant learner records, assessment information, course administration and customer communications.

Privacy Policy:

15. Cookies and Third-Party Services

The Website may use cookies and similar technologies. We will provide appropriate information and obtain consent where required by law.

Our Cookie Policy should explain the technologies used on the Website, their purposes and how visitors can manage their preferences.

Cookie Policy:

The Website or our services may use third-party platforms for payment processing, online learning, communications or other functions. Third-party services may be subject to their own terms and privacy notices.

This does not remove any obligations we owe under our own contracts or applicable law.

16. Website Availability and Security

We aim to maintain the security and availability of the Website and our online services but cannot guarantee uninterrupted or error-free operation.

We may temporarily suspend access for maintenance, updates, security measures or technical reasons.

Where a paid service is materially affected by an issue for which we are responsible, we will address it in accordance with the applicable agreement and statutory rights.

You are responsible for ensuring that your devices, software and internet connection are suitable for accessing our online services, unless otherwise agreed.

17. Third-Party Websites

The Website may contain links to third-party websites, platforms or services.

These links are provided for convenience. We do not control independent third-party websites and are not responsible for their content, availability or privacy practices.

This does not affect any responsibilities we retain under our own contracts or any rights you have under applicable law.

18. Limitation of Liability

Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

For consumers, nothing in these terms restricts statutory rights or remedies, including applicable rights concerning services and digital content.

For business customers, any additional limitations of liability must be set out in the applicable business agreement and remain subject to applicable law.

We will not be liable for losses arising solely from circumstances outside our reasonable control, except where the law or our contractual obligations provide otherwise.

These terms do not exclude liability for a failure to provide services with reasonable care and skill where such exclusion would be unlawful.

19. Changes to the Website and These Terms

We may update the Website and these Terms and Conditions from time to time.

The current version will be published on the Website with its latest revision date.

Changes will apply from the stated effective date, subject to applicable law. We will not use these terms to remove rights already agreed with a customer or make material changes to an existing contract without an appropriate legal or contractual basis.

Where changes materially affect an existing paid service, we will notify affected customers where required.

20. Complaints

If you have a complaint about our Website, training or services, please contact us at:

Email: info@thehospitalitytrainingcompany.co.uk

Please provide details of the course or service concerned and the nature of your complaint so that we can review it.

We will consider complaints fairly and respond within a reasonable period.

Course-specific complaints, assessment appeals or qualification complaints may also be subject to the procedures of the relevant awarding organisation. Where applicable, we will explain how to access those procedures.

21. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory legal protections that apply.

The courts of England and Wales shall have jurisdiction over disputes, subject to any mandatory rights consumers may have to bring proceedings elsewhere.

22. General Provisions

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision immediately does not constitute a waiver of that provision.

These terms do not create a partnership, agency or employment relationship between you and us.

These Terms and Conditions should be read alongside any applicable course-specific conditions, business training agreements, Privacy Policy and Cookie Policy.
